NIW Strategy Assessment

$950. A written, attorney-prepared analysis of your EB-2 National Interest Waiver profile, what supports it, what is missing, and what to do next, followed by a 45-minute meeting with the attorney.

By invitation, after the free self-screen and a written attorney review.

No numerical score. No approval prediction. No guarantee. USCIS decides every petition on its own record.

What you receive

  1. A written NIW Strategy Assessment memorandum, typically 8–12 pages, covering:
    • your profile and the EB-2 threshold;
    • your proposed endeavor and how to frame it;
    • each part of the three-part national-interest test;
    • your strongest evidence and the main gaps;
    • practical evidence-development recommendations;
    • recommendation-letter and technical-evidence strategy;
    • filing timing and visa-bulletin timing for your country of birth;
    • risks;
    • other categories worth considering;
    • a clear next-step recommendation.
  2. A 45-minute meeting with the attorney after you have read the memo. It is for your questions and your decision.

What the attorney reviews: a defined file, not unlimited documents

To keep the Assessment focused, you send what the analysis actually needs, in three steps:

  1. Core file: your CV, a structured questionnaire (about 20 minutes), and your proposed endeavor in your own words (up to 300 words).
  2. Evidence inventory: a form where you list your evidence by category (degrees, research, patents, open source, standards or security work, recognition, leadership, entrepreneurial work, possible recommenders). You list items; you don't upload them.
  3. Attorney request: the attorney asks for the specific documents needed, up to 12 documents / 100 pages in total, plus up to 5 public profile links. Only requested items are uploaded.

Please don't send passports, full immigration histories, tax records or anything confidential from an employer unless the attorney specifically asks for it. Employer confidential material is never accepted.

Timeline

The memo is delivered 7 business days after your file is complete. Your file is complete when all of these are done:

The meeting is scheduled within 5 business days after the memo.

Fee and credit

$950, paid when you sign a short limited-scope engagement letter. You can buy the Assessment without committing to representation.

If you go ahead: representation

NIW representation. Standard NIW representation is typically a $9,500 flat attorney fee after assessment. Matters requiring materially expanded technical, entrepreneurial, evidentiary or interdisciplinary work are quoted separately after the Strategy Assessment. Government filing fees and later green-card, consular or adjustment work are separate.

What the Assessment is not

Who it is for

Professionals, typically engineers, data scientists and researchers, who want an honest, specific read on their NIW strategy before investing in letters and a petition. Publications and patents are not required to benefit from it.

How to start

  1. Take the free self-screen.
  2. Request an attorney review. It is in writing, with no call, and a conflict check comes first.
  3. If the Assessment appears to be a reasonable next step, you receive an invitation and the engagement letter.

FAQ

Is there a free consultation first? The free step is the self-screen, followed by a written attorney review of your request. There is no free call. The Assessment is where the attorney's full analysis happens.

Can I get a refund? If the firm declines after the conflict check, or if you withdraw before the analysis begins, you are refunded in full. After the analysis begins, any unearned portion is refunded if the Assessment is not completed, as the engagement letter states.

What if I need more than 12 documents reviewed? Most profiles don't. If yours genuinely does, the extra review is quoted in writing before any work starts.
